Confusion regarding creamy layer

I went through the Creamy layer conditions but couldn't confirm if I belong to creamy layer or not. Here is my scenario: My father is a govt employee but not from class I or II. My mother is a private employee(not engineer/doctor etc) earning salary about 5-6 lpa. We have no alternative income other than the salary. Our total annual income is more than 6 lpa but there is also a point that children of other than class I and II employees are eligible for Non-Creamy Layer.
I am also confused regarding another point that salary and agricultural income should not be clubbed. Does it mean we should not consider salary part in our annual income?(which is highly improbable though)

Can someone tell me if I belong to Creamy or Non-Creamy layer. Is govt employee's income added to total income for deciding 6lpa criteria?

  • See, Ur father's salary will not be considered for creamy layer calculation. However if ur mother's income crosses 6 lakh per annum u will be considered as creamy layer and would not be entitled for reservation benefits.
    The clause for salary and agriculture is true but should not be clubbed.
    exemption from salary income is for govt employees.
    ur mother income from salary is to be considered for creamy layer certification, That to it should not cross continuously Rs 6 lakh in the preceding 3 years ITR.

    Going by your conditions, I presume you won't be considered in the creamy layer and your eligible for OBC reservation.

    It's wrong calculation. Only father gets exemption from salary criteria. If mother's gross income in the ITR for last 3 years is above 6lacs he will fall in creamylayes so loses benefit of reservation
  • I am in same confusion. Lot of misleading information being spread by people. Here is my scenario. My mother is primary teacher in government school and we have a small shop run by my father. Salary of my mom will be in between 5 to 5.5 lakhs while there is hardly any income from shop. Total income for last year will be around 5.70 Lakhs. I have applied for non creamy layer and will get with 3 years validity. Due to 7th pay commission it could go above 6lakh threshold. So as per information i got it will be last non creamy layer certificate for me. But as many saying payment of government employees apart from 1st and 2nd class does not matter in non creamy layer calculation. Will i get NCL in future if required?
  • @PalindromeGuy @CMPunk Go to the ministry of minority affairs website. You will find the full OBC rules and regulations uploaded there in the pdf format. Download it and read the necessary provisions. All your doubts will be cleared.

    my mom is a govt teacher in primary school (clasII/iii whatever) and my father PSU employee but his salary has been less than 6 lakh for previous 2 years. but the total combined salary will cross 10 lakhs.
    how will my NCl status will be considered ? whether my parents will be individually considered (in that case i will belong to NCL ) or income criteria will apply ?if income criteria applies( on the basis of PSU rules) then will the income of both parents be taken together?
